Terms & Conditions

These Terms and Conditions ("Terms") describe the terms and conditions for participation in the Truly Not Limited Publisher Program. In this agreement, the term "Publisher" refers to you, the applicant. Truly Not Limited ("we," "our," or "us") refers to the product owner and publisher, registered in Hong Kong.

1. Enrollment in the Publisher Program

To enroll in the publisher program, all publishers must sign up through one of our third-party platform partners: Digistore24, ClickBank, or BuyGoods. The publisher program is governed by the rules, regulations, terms, and conditions dictated by these platforms.

2. Commissions

Publishers will receive a percentage of the revenue as a commission from orders placed through properly coded publisher links (unless noted otherwise for a particular product). Commissions are subject to change at the discretion of Truly Not Limited. To generate a commission, the customer must complete the order form and remit full payment for the product ordered through our secure system. Properly coded links are the sole responsibility of the publisher.

3. Payment

Payment of commissions will be made by our platform partners (e.g., Digistore24, ClickBank, or BuyGoods) in accordance with their payment schedules and policies. If any order that generated a commission is returned by the customer, or if there are any returned checks or chargebacks, the amount will be deducted from the next payment due to the publisher.

4. Order Fulfillment

Truly Not Limited will be solely responsible for processing every order placed by a customer. Publishers are not authorized to collect payments or sell any Truly Not Limited products from other websites as a "reseller," and no "resale" rights are granted in any way. Publishers are not authorized to sell these products on auction sites. Truly Not Limited will also be solely responsible for all customer service inquiries.

5. Customer Relations

Customers who purchase products and services through the publisher program will be deemed to be customers of Truly Not Limited. Accordingly, all rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time.

6. Qualifying Sites

Our platform partners reserve the right to refuse any site entry into the publisher program based on site content. Sites that do not qualify for the program include those that promote sexually explicit materials, violence, discrimination, illegal activities, or infringe on intellectual property rights.

7. Anti-Spam Policy

Truly Not Limited strictly prohibits the use of spam email and other forms of Internet abuse to seek sales. Spam is defined as sending electronic mail messages to recipients with whom the sender does not have an existing business or personal relationship or is not sent at the request of, or with the express consent of, the recipient through an opt-in subscription.

8. Relationship of Parties

Publishers are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. Publishers have no authority to make or accept any offers or representations on our behalf.

9. Term and Termination

The term of this Agreement will begin when you accept and will end when terminated by either party. Truly Not Limited or the publisher may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination.

10. Limitation of Liability

Truly Not Limited will not be liable for indirect, special, or consequential damages arising in connection with this Agreement or the Program. Our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to the publisher under this Agreement.

11. Disclaimers

We make no express or implied warranties or representations with respect to the Publisher Program or a publisher's potential to earn income from the Publisher Program. In addition, we make no representation that the operation of our websites or the Publisher links will be uninterrupted or error-free.

12. Earnings Disclaimer

Any earnings or income statements, or earnings or income examples, are only estimates of what we think you could earn. There is no assurance you will do as well. If you rely upon any sales figures we provide, you must accept the risk of not doing as well.

13. Assignment

You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. This Agreement will be binding on and enforceable against the parties and their respective successors and assigns.

14. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

15. Miscellaneous

Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to enforce such provision or any other provision of this Agreement.
